Supporting Digital Exporters: NZTech Submission on Reducing Trade Barriers

Submission by NZTech to the Ministry of Foreign Affairs and Trade (MFAT)

NZTech has submitted feedback to MFAT on the proposed Open Plurilateral Arrangement to Resolve Non-Tariff Barriers (NTBs), highlighting the urgent need to support New Zealand’s growing digital export sector.

While traditional exporters often face tariffs, tech exporters are increasingly challenged by NTBs such as restrictive visa rules, inconsistent IP protections, complex regulations for establishing local presence, and fragmented digital standards. These barriers limit the ability of Kiwi companies to scale globally.

NZTech’s submission emphasises the need to distinguish between digitally-enabled trade (e.g. e-invoicing for dairy exports) and digital exports (e.g. SaaS, AI, gaming). While existing trade agreements support the former, digital exports require more tailored, enforceable rules.

NZTech recommends:

  • A coordinated NTB strategy covering AI, privacy, and platform regulation
  • Greater alignment across digital trade agreements
  • A permanent WTO moratorium on digital tariffs
  • Resourcing MFAT to tackle digital NTBs
